2008 WIRELESS TELEPHONE LAWS

The new wireless telephone laws go into effect on
July 1, 2008.  How will these new laws affect you?

 If you are UNDER 18

When can I use my cell phone while driving?
NEVER.  The only exception to this is in emergency situations when you are calling the police, fire department or medical authorities (VC § 23124).

Am I allowed to use a hands free device like blue tooth?
No. Drivers under the age of 18 may not use a wireless phone to speak or text while driving in any manner, including a hand free device.

Can my parents give me permission to use my cell phone while driving?
No. Like all other laws your parents cannot give you permission to violate this law. 

Does this law apply to me if I am an emancipated minor?
Yes. This law applies to everyone under the age of 18.

What exactly does this law restrict?
The new Vehicle Code § 23123 prohibits all drivers from using handheld wireless telephones while operating a motor vehicle.  You are allowed to use a hands free device and are not restricted from dialing while driving. Using a blue tooth or other hands free device is legal, but you may not have both ears covered.  You will also be allowed to use the speaker function of your cell phone while driving.

Am I allowed to text while driving?
The law does not specifically prohibit texting while driving for those over the age of 18.  However an officer can pull you over and issue a citation if, in the officer’s opinion, the driver was distracted and not operating the vehicle safely. 

What are the fines if I’m convicted?
The base fine for the first offense is $20.00 and $50.00 for the next offense.  These fines are subject to additional penalty assessments that will raise the total cost of these tickets to $76.00 for the first and $96.00 for every additional ticket.

Will I receive a point on my driver’s license if I am convicted?
No. This violation is a reportable offense; however the DMV will not assign a violation point.

Will this conviction appear on my driving record?
Yes, but no violation point will be added.
